ALBANY — A Ballston Lake attorney with five decades of legal experience was suspended Thursday after failing to respond to allegations he failed to reimburse a client’s fees, an appeals court heard.

Robert Morris Cohen, an attorney since 1972, allegedly failed to return unearned fees and then ignored requests from a group of grievance attorneys investigating the complaint, according to the Third Department of Justice’s Appellate Division ruling. the state Supreme Court.

The court said Cohen did not respond to attempts by the grievance committee to obtain records and summon Cohen to testify under oath about the allegations.

The committee, part of the Third Department, requested Cohen’s suspension pending his cooperation with their investigation.

On Thursday, the Third Department judges unanimously agreed to impose the suspension. Their ruling said that Cohen’s failure to comply with the committee’s request “not only constitutes professional misconduct immediately threatening the public interest, but also clearly undermines the effectiveness of the attorney disciplinary system.”

Reached by phone Thursday, Cohen declined to comment.

Presiding Judge Elizabeth Garry and Judges Sharon Aarons, Molly Reynolds Fitzgerald, John Colangelo and Eddie McShan imposed the discipline.
